Built from a run recorded on 24 Sep 2026 against the live services.
A public buyer that orders an AI system is buying a regulated product. Suppose the system falls under Annex III of the EU AI Act. Then the supplier who builds it and puts it into service under its own name is its provider, with the provider’s duties. The procurement law of the buyer’s country then decides whether the supplier may bid at all. A bid manager needs all three answers before the go/no-go meeting.
The company in this run
We ran that check on 24 September 2026 for an illustrative company: an 18-person Vilnius software firm. It builds computer-vision and document-AI systems and has delivered two projects for Lithuanian municipalities. It would develop the system and put it into service for the buyer under its own name. The company is made up.
The tenders, the regulation text and the law came from the live services, in one conversation through Datailo. Datailo connects an assistant to Victano (tenders), Rekvira (EU regulation) and Avokata (Lithuanian law).
Step 1: find a tender that is really about AI
The first searches were limited to Lithuania, in Lithuanian (“dirbtinio intelekto sistema”) and in English (“artificial intelligence system development”). Both returned the same 1,546 open Lithuanian notices. None of the five shown first was an AI system: medical equipment, a fire-pipe replacement, a data-centre hardware purchase. On that day the keyword did not narrow the Lithuanian set.
Widening the same English query to every country returned 72,263 open notices with AI projects at the top:
| Notice | Buyer | Deadline |
|---|---|---|
| Call for Tenders for the selection of Artificial Intelligence Gigafactory Consortia (TED 529135-2026) | European High-Performance Computing Joint Undertaking, Luxembourg | 12 Nov 2026 |
| Enhanced cognitive EW system with intelligent RESM CESM signal analysis | European Defence Fund | 29 Sep 2026 |
Deadlines are as the notices stated them on 24 September 2026; most have passed by the date of this guide. The lesson for a small firm is practical. Search in the notice language and across borders, and read the deadline before anything else.
Step 2: is the system high-risk under the AI Act?
Suppose the buyer wants a system that helps a municipality decide who is eligible for social assistance. Rekvira searched the AI Act for that use. It put Annex III, point 5 first: “Access to and enjoyment of essential private services and essential public services and benefits”. Its point (a) covers AI systems used by public authorities or on their behalf. Article 6(2), read in full, makes the link:
“In addition to the high-risk AI systems referred to in paragraph 1, AI systems referred to in Annex III shall be considered to be high-risk.”
Source: Regulation (EU) 2024/1689, Article 6(2), as held by Rekvira (text as of 2 September 2026).
Whose call is the classification?
Classification is the company’s call, made on the system’s actual purpose; the run lays out the test and the text. Rekvira holds the Regulation as published in 2024. Before you put a classification in a bid, check the current consolidated text on EUR-Lex for later amendments.
Step 3: what does the provider have to do?
lookup_obligations for providers of high-risk systems returned seven articles, starting with Article 16,
“Obligations of providers of high-risk AI systems”. Read in full, Article 16 lists twelve duties. The ones a bid must
plan and price for:
| Article 16 | What the provider must do |
|---|---|
| (a) | ensure the system complies with the requirements in Section 2 |
| (c) | have a quality management system that complies with Article 17 |
| (d), (e) | keep the documentation (Article 18) and, when under its control, the logs (Article 19) |
| (f) | have the system undergo the conformity assessment of Article 43 before it is placed on the market or put into service |
| (g), (h) | draw up an EU declaration of conformity (Article 47) and affix the CE marking (Article 48) |
| (i) | comply with the registration obligations of Article 49(1) |
| (l) | ensure the system meets the accessibility requirements of Directives (EU) 2016/2102 and 2019/882 |
A bid may promise delivery without a plan for points (c), (f) and (i). It then promises something the company may not be able to do on the buyer’s timetable.
Step 4: may the company bid at all?
For a Lithuanian buyer the exclusion grounds sit in Article 46 of the Public Procurement Law (Viešųjų pirkimų įstatymas, No I-1491, in force). Avokata returned it first, in Lithuanian.
Which grounds exclude a supplier?
Paragraph 1 requires the buyer to exclude a supplier convicted of listed crimes. Among them are participation in a criminal organisation, bribery, fraud against the EU’s financial interests, criminal bankruptcy and money laundering. Paragraph 4 lets the buyer exclude a supplier that is insolvent or has committed a grave professional misconduct in the last year.
The article’s opening words
“Perkančioji organizacija pašalina tiekėją iš pirkimo procedūros, jeigu patikrinusi jį pagal šio įstatymo 50 ir 51 straipsnių nuostatas ar kitu būdu sužino, kad tiekėjas arba jo atsakingas asmuo […] nuteistas už šią nusikalstamą veiką”
(The contracting authority excludes a supplier from the procurement if it learns that the supplier or its responsible person has been convicted of one of these crimes. It may learn this by checking under Articles 50 and 51, or otherwise.) Source: Viešųjų pirkimų įstatymas on e-TAR.
For a buyer in another country, the same check runs against that country’s law; Avokata covers Lithuania only.
What the run did not do
It did not decide to bid, classify the system for the company, or read the tender documents. A full bid pack (the specification read line by line, a compliance matrix, questions for the buyer) is the Datailo job “Bid on a public AI tender”. Its recorded run is not published yet, so this guide shows the separate checks, not the job.
This guide does not advise anyone on the law. The services return sources, and a lawyer reads them.
